18 The Book of Divorce

كتاب الطلاق

(1) Chapter: The prohibition of divorcing a menstruating woman without her consent; If a man breaks this rule, it still counts as a divorce, and he should be ordered to take her back

باب تَحْرِيمِ طَلاَقِ الْحَائِضِ بِغَيْرِ رِضَاهَا وَأَنَّهُ لَوْ خَالَفَ وَقَعَ الطَّلاَقُ وَيُؤْمَرُ بِجْعَتِهَا

This hadith has been narrated on the authority of Shu’ba with the same chain of transmitters but with a slight variation in wording.

وَحَدَّثَنِيهِ يَحْيَى بْنُ حَبِيبٍ، حَدَّثَنَا خَالِدُ بْنُ الْحَارِثِ، ح وَحَدَّثَنِيهِ عَبْدُ الرَّحْمَنِ بْنُ، بِشْرٍ حَدَّثَنَا بَهْزٌ، قَالاَ حَدَّثَنَا شُعْبَةُ، بِهَذَا الإِسْنَادِ غَيْرَ أَنَّ فِي، حَدِيثِهِمَا ‏ “‏ لِيَرْجِعْهَا ‏”‏ ‏.‏ وَفِي حَدِيثِهِمَا قَالَ قُلْتُ لَهُ أَتَحْتَسِبُ بِهَا قَالَ فَمَهْ ‏.‏
